3. PURCHASE PROCESS

4. AVAILABILITY

5. PRICES AND PAYMENT

We offer you different payment methods:

a. Payment via credit/debit card

You can complete payment instantly via our Bank’s SSL secure payment gateway. If any refund or cancellation of the order is required, the amount will be refunded via the same payment card. Credit cards will be subject to checks and authorisations by the issuing bank, CASTRO Y GONZALEZ will not be responsible for any delay or failure to delivery due to this reason.

By clicking on “Authorise Payment” or “Confirm Payment”, the User confirms that the credit card used is his/her own or that they are the rightful holder of the payment card or gift voucher.

b. Payment via bank transfer

6. DELIVERY

In cases where the physical delivery of the contracted good is carried out, the deliveries shall take place in the following territory: Mainland Spain, Balearic Islands, Ceuta, and Melilla. In addition, AURELIO CASTRO Y GONZALEZ, S.A. will ship to Germany, Austria, Bulgaria, Belgium, Cyprus, Croatia, Denmark, Slovakia, Slovenia, Estonia, Finland, France, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Czech Republic, Romania and Sweden.

At present and due to the current situation in Spain and Portugal, CASTRO Y GONZALEZ will provide free shipment, carrying out a shipping policy.

For all other countries, there are two modes of transport to be chosen by the User:

STANDARD shipment: 40.00 Euros
EXPRESS shipment: 120.00 Euros

In the case of standard shipping, this will be free on orders over €500.00.

If for any reason attributable to CASTRO Y GONZALEZ, the latter is unable to meet with the delivery date, the User will be contacted and informed of this circumstance and will have the option of continuing with the purchase by establishing a new delivery date, changing the delivery address or cancelling the order with a refund.

In the event of effective impossibility to deliver the order due to absence of the User, the order shall be returned to the warehouse. However, the carrier will leave a notice explaining the day and time of the delivery attempt, where the order is located and how to proceed for a new delivery attempt. If due to any incident, the User will not be at the designated address, please contact CASTRO Y GONZALEZ to change the address or postpone the delivery.

If for any reason, a second delivery attempt is made and could not be completed, it will be understood that the User wishes to withdraw from the contract and said contract will be deemed to be resolved. As a result of the termination of the contract, all payments made by the User will be refunded, excluding any additional expenses incurred.

For the purposes of these Terms and Conditions, it shall be deemed that the delivery has taken place or that the order has been delivered at the time that you or a third party on your behalf takes possession of the products, which will be accredited with the signing for receipt of the order at the delivery address provided by the User.

7. TECHNICAL MEANS TO CORRECT ERRORS

8. RETURNS

Right to withdraw

The User, in accordance with Article 68 and 102 of Royal Legislative Decree 1/2007, of 16 November, approving the General Law for the Defence of Consumers and Users, has the right to withdraw within a period of 14 calendar days without being required to provide any justification.

Regardless of the means that the User chooses to communicate the exercise of his/her right, it is essential to clearly and unequivocally express the intention to withdraw from the contractual relationship. In any case, the User may use the model of withdrawal form which CASTRO Y GONZALEZ may make available, although under no obligation to use this form.

In the event of withdrawal, CASTRO Y GONZALEZ will reimburse the User for all payments received, including shipping costs, via the same means as the User used for making the payment (with the exception of additional costs chosen by the User for a mode of shipment other than the least expensive mode used by https://castroygonzalez.es/) without any undue delay and, in any case, no later than 14 calendar days from the date on which CASTRO Y GONZALEZ is informed of the decision to withdraw.

However, CASTRO Y GONZALEZ may retain said refund until the purchased products or goods have been returned, or until the User provides proof of their return.

The User shall be solely responsible for the decrease in value of the goods resulting from a handling that is different from that necessary for establishing the nature, characteristics, and operations of the goods.

The User acknowledges the exceptions to the right of withdrawal, as stated in Article 103 of Royal Legislative Decree 1/2007, of 16 November, approving the General Law for the Defence of Consumers and Users:

The supply of goods that may deteriorate or expire rapidly.
The supply of sealed goods which are not eligible for return due to health protection or hygiene reasons and which have been unsealed after delivery.

Likewise, all products must also be returned using or including all original packaging, instructions and other accompanying documentation, and a copy of the purchase invoice.

Return of defective products or shipping error

We refer to all cases where the User considers that, at the time of delivery, the product does not conform to the terms of the contract or purchase order, and that, therefore, the User should contact CASTRO Y GONZALEZ immediately to inform of the existing non-conformity (defect/error) via the same means or using the contact details provided by the previous section.

The User will then be informed of how to proceed in cases of returning products, and these, once returned, shall be examined and the User will be informed, within a reasonable period of time, whether the issue will be resolved by means of a refund or, where appropriate, the replacement of the same.

The reimbursement or replacement of the product shall be carried out as soon as possible and, in any case, within 14 days following the date on which we send you an email confirming that we are going to reimburse or replace the product that you are not satisfied with.

The amounts paid for those products shall be returned in the event of any defect or fault, when this actually exists, shall be fully reimbursed, including the delivery costs incurred for delivering the item and the costs the User has paid for returning the product to us. 9. EXEMPTION FROM LIABILITY

Except as otherwise provided by law, CASTRO Y GONZALEZ will not accept any liability for the following losses, regardless of their origin:

Any loss that is not attributable to any failure on its part.
Business losses.
Indirect losses that were not reasonably foreseeable by both parties at the time of entering into the sale contract.

Similarly, CASTRO Y GONZALEZ only limits its liability to the following cases:
